ONLINE SHOP REGULATIONS (updated 20.062012)

 I. Definitions:

1. Customer – any natural or legal person or an unincorporated entity with legal capacity that places an Order in the Shop;

2. Polish Civil Code – Act of 23rd April 1964 (the Journal of Las nr 16 item 93, with further amendments);

3. Regulations – regulations concerning providing services by the Online Shop;

4. Online Shop (Shop) Sklep internetowy (Sklep) - Internet service found at, where Customers can place Orders;

5. Product – articles found at the Online Shop

6. Sales agreement – sales agreement, as understood by the Polish Civil Code, applies to the sales contracts concluded by Fastima Marcin Wajda, ul. Promienista 5/2, 60-288 Poznań, entered to the registry of traders, and the Customer via the Online Shop service;

7. Act on specific terms and conditions of consumer sale and amendments to the Polish Civil Code - Act of 27th July 2002 on specific terms and conditions of consumer sale and amendments to the Polish Civil Code (the Journal of Laws nr 141 item 1176, with further amendments);

8. Act on rendering electronic services - Act of 18th July 2002 on rendering electronic services (the Journal of Laws nr 144 item 1204, with further amendments);

9. Order - Consumer’s statement of will, leading directly to conclusion of the Sale Agreement and including type and quantity of Products.


II. General provisions

2.1. The conditions of using the Online Shop are regulated by this document, hereinafter referred to as the “Regulations”.

2.2. The Regulations are a document as understood in article 8 of the Act on rendering electronic services.

2.3. The Online Shop found at is run by Fastima Marcin Wajda, ul. Promienista 5/2, 60-288 Poznań, entered to the Central Business Activity Registration and Information Office.

2.4.The Regulations specify :

a.) terms and conditions of the Online Shop registration and account usage;

b.) terms and conditions of making reservations of products available on the shop’s website;

c.) terms and conditions of online order placement via shop’s website;

d.) terms and conditions of Sales Agreements to services rendered by the Online Shop;

2.5. In order to use Online Shop the Customer must gain access to a computer or a mobile device with the Internet access.

2.6. Customers can access and print Regulations at any time by using the link found at the home website .

2.7. Product information like descriptions, technical and usage parameters and prices are found at the Online Shop’s websites and constitute an invitation to entering an agreement as understood by Article 71 of the Polish Civil Code.

III. Rules and regulations of using the Online Shop

3.1. A necessary condition to use the Online Shop is registration in its system.

3.2. Registration is made by accepting and filling in the registration form available on the Shop’s website.

3.3. Necessary conditions of registration are accepting the Regulations and filling in the obligatory personal data.

3.4. In cases of Regulations’ violation the Shop’s owner may deprive the Customer of the right to use the Online Shop, as well as limit their access to parts or whole Online Shop’s resources, with immediate effect especially if the Customer:

a.) gave false, inaccurate or outdated data that are misleading or violate a third party’s rights.

b.) infringed third parties’ personal interests, especially other Customers’ personal interests, via the Online Shop.

c.) behaved in a way that is considered unlawful or contrary to the general rules governing the use of the Internet by the Shop’s Owner, or tarnished his good reputation among other Customers.

3.5. An individual that has been deprived of their right to use the Online Shop, cannot register again without the Shop’s owner previous assent.

3.6. In order to ensure security of data transmission, the Online Shop implements all necessary technological and organizational measures to make sure that the Customer’s personal data are processed with observance of the security rules determined by appropriate regulations and are not accessible to any third parties.

3.7. The Customer:

a.) must not deliver or forward any unlawful content e.g. violent content, slandering or infringing personal interests and other rights of the third parties.

b.) must use the Online Shop without disruption to the functioning of the service, especially by the use of particular equipment or software,

c.) must not take actions like sending or posting on the Shop’s website unsolicited commercial information (spam),

d.) must use the Online Shop in a way that is non-arduous both for other Customers and for the Shop,

e.) must respect that all accessible at the Online Shop content is for personal use only.

f.) must use the Online Shop in compliance with the Polish legal regulations, provisions of the Regulations and general rules governing the use of the Internet.


IV. Sales Agreements

4.1. In order to enter into a sales agreement the Customer must choose Product type and size at and then carry out technical actions specified by displayed messages and information found on the website.

4.2. In order to choose a Product Customer must add it to the basket.

4.3. While placing an Order – before clicking the „order” button – Customer can modify the entered data and chosen Product. In order to do so one needs to carry out technical actions specified by displayed messages and information found on the website.

4.4. After submitting all the necessary data the Customer will see a summary of the Order placed. The summary contains information about:

a.) ordered Products,

b.) unit price and all-in price of ordered products or services, including delivery costs and any additional cost (if applicable)

c.) form of payment,,

d.) form of delivery,

e.) time of delivery,

4.5. The Customer must accept the terms of the Regulations, fill in required personal data and click on the “order” button to place an Order.

4.6. Sending an Order is tantamount to agreeing to enter into Sales Agreement with the Shop’s owner, as understood by the Regulations.

4.7. After placing an Order, Customer will receive a confirmation email with all relevant information about the Order.

4.8. The Sale Agreement is concluded once the Customer has received the above mentioned confirmation email.

4.9. The Sales Agreement is complaint with the terms of the Regulations and signed in Polish.


V. Delivery

5.1. The Products ordered in the Shop are delivered nationwide to the address given by the Customer when placing an Order.

5.2. The ordered Products can be delivered by Post, via courier mail or InPost or can be collected by the Customer. Each Order is dispatched according to prices found in terms of the Agreement.

5.3. Each Order is dispatched within 1 to 3 working days after the payment was posted.

5.4. The clients can access, upload or print the Regulations at any given time form the home website of

The Customer receives, both by email and with the ordered Product, documents that fix, secure, disclose and ratify the terms of the Sales Agreement: Order confirmation and specification, and VAT invoice.

VI. Prices and methods of payment

6.1. The prices of Products are given in Polish Zloty (PLN) and include all costs, like VAT (including tax rate), customs duty and any other additional costs.

6.2. The Customer can pay:

a.) by money transfer to the bank account

c.) by credit card payment through the safe online payment system

VII. Withdrawal from the Agreement

7.1. The Customers, as provided in the Polish Civil Code, are entitled to withdraw from the Agreement without giving any reasons within 10 days by sending a written statement of withdrawal from the agreement to .

7.2. The Product’s delivery date is the start date of the 10 day period.

7.3. The Customer is not entitled to withdraw from the Agreement if:

  • They ordered a Product that is not on Shop’s standard offer and was custom made to fit the Customer’s individual needs.

7.4. In case of withdrawal from the Agreement, the Agreement is deemed null and void. The amount paid by the Consumer will be returned and the Consumer is bound to return Products in unused condition within 14 days to the address:

7.5. The returned Products should be properly packed and arrive unused and without any damages.

7.6 Shipping and packaging costs of the returned Product shall be paid by the Customer. 

7.7. The amount paid by the Customer will be returned within 14 days.

VIII. Complaints

8.1. The Shop’s owner is liable to the Customer for the Product variance with the Sale Contract in accordance with § 10 ust. 2 of the law from 27th of July referring to special conditions of consumer sales and amendments in the Civil Code (Dz.U.z 2002r. Nr 141, poz. 1176 ze zm.),

8.2. Complaints resulting from the infringement of consumer rights as understood by the Polish Civil Code or the terms of the Regulations are to be send The Shop’s owner will adjust all complaints within 14 days from receiving the Product and all required documents or, in case when it is not possible, will notify the Customer when the complaint will be adjusted.

8.3. The Shop’s owner is not the manufacturer of sold Products.

IX. Final provisions

9.1. Any disputes between the Shop’s owner and the Customer who, as understood by Article 221 of the polish Civil Code is a consumer, will be resolved by courts indicated by the appropriate regulations in the Polish Civil Code.

10.2. Any disputes between the Shop’s owner and the Customer who, as understood by Article 221 of the polish Civil Code, is not a consumer will be resolved by a court of the Shop’s owner jurisdiction.

10.3. In matters not regulated by the Regulations, provisions of the Polish Civil Code, the Act on rendering electronic services and other appropriate provisions of the Polish Law shall apply.
